Regarding that article.
There was a curious single line of text that said that ramblers could also
use the trails. Note, ramblers not walkers. It appeared almost like an
afterthought.
As a result of the article, two folk I know who don't ride mountain bikes
and had read the article said they didn't know you could walk on mountain bike
trails.
They said that their previous view was taken from a common sense standpoint.
They didn't know if walking on purpose-built trails was actually verbotten
or just nor responsible access as it would be getting in the way of riders.
Clearly their understanding of the access situation was thoughtful if not
wholly informed. The upshot was that they thought tyhey had carte blanche to
walk on mountain bike trails when prior to this the article they wouldn't have
considered it.
As you will all be aware (I now paraphrase S6 of the LR(S)A) there is no
lawful access on land set apart or developed for a particular recreational
purpose while it is in use as such except for those engaged in that particular
recreational activity.
Reading theHerald article carefully it is just the Contin ones that
particular line of text refers to.
Presumably these are being built as multi-use trails and should be ridden as
such ie with the presumption that you'll meet a walker/equestrian willingly
give way to them.
Howeve, it wouldn't be surprising to see a load of folk who'll just fancy a
toddle along trails elsewhere that were built wholly as single use facilities
and therfore are subject to the provisions of s6.
Thin end of wedge?
